Overtime Election Forms (Compensatory Time Agreement)

Non-exempt employees are entitled to compensation at the time and one-half rate (premium rate) for all hours worked after 40 hours in a workweek. In accordance with the Fair Labor Standards Act (FLSA), and as outlined in various bargaining unit contracts and UC policy manuals, overtime will be compensated at the appropriate rate either by pay or compensatory time off (if the department offers comp time off).

The forms are specific to employee bargaining units. There is also a form available for employees that are not represented by a bargaining unit ("non-represented" employees, also called 99's). If the employee is not represented by a bargaining unit, or if the employee's bargaining unit is listed, the Department should retain a signed copy of the form. If the employee's bargaining unit is not listed, a form is not required.

The purpose of the form is to indicate which method the employee prefers to receive overtime compensation: pay or compensatory time off. Note that compensatory time is only available if the Department offers it, and it is the Department's discretion to discontinue offering compensatory time ("comp time") off.
